The present Cr.M.P. has been filed with the following prayer:- It is, therefore, prayed before this Hon'ble Court that in the light of submissions made hereinabove and by looking into the facts and circumstances of the case this Hon'ble Court may kindly be pleased to allow the present petition filed under section 482 of Criminal Procedure Code, 1973 and grant following relief to the Petitioners: (I) That, this Hon'ble Court may kindly be pleased to call for the entire records pertaining to the Criminal Case bearing No. 1348/2021 State of Chhattisgarh v. (ii) That, this Hon’ble Court may kindly be please to pass an apropriate order for quashing of the impugned charge- 3 sheet dated 29.01.2021 which is filed before the Learned JMFC, Raipur on 11.07.2022 against the petitioners (iii) That, this Hon'ble Court may kindly be please to pass an appropriate order for quashing of entire criminal proceeding initiated vide Criminal Case bearing No. 1348/2021 State of Chhattisgarh v. Sameer Chand Suman and others pending before the Learned JMFC, Raipur Chhattisgarh, so far as it relates to the Petitioners. (iv) That, any other relief which this Hon’ble Court may deem fit in the interest of justice, may kindly be awarded. 2. At the very outset, learned counsel for the petitioner seeks permission of this Court to withdraw this petition with liberty to challenge the charge, as the charges have been framed and the case is fixed for evidence. 3. Accordingly, the instant Cr.M.P. is dismissed as withdrawn with the liberty to take recourse to law, as may be available to him, if matter still survives.
