Mr. Bhupinder Singh Ahuja, Advocate, for the respondent. CMP(M) No.2216 of 2025 The present application has been filed by the applicants for condonation of delay in filing the appeal. It has been averred in the application that impugned judgment and decree dated 03.12.2024 was passed by the learned District Judge, Bilaspur, District Bilaspur, H.P. Further it was averred in the application that the District Attorney Bilaspur vide his ofÏce letter, intimated the Department that the said Civil Appeal which was pending before the learned District Judge, Bilaspur has been dismissed. On the receipt of the letter of the District Attorney, Bilaspur, the case was forwarded to the Superintendent Engineer, Bilaspur and thereafter the case was dealt by different ofÏcials through different channels. Therefore, in this process, the delay has occurred which is neither intentional nor willful and the same has occurred due to unavoidable circumstances, which were beyond the control of the applicant. The non-applicant has no objection in case the delay in filing the appeal is condoned. Keeping in view the averments as made in the application, which is duly supported by an afÏdavit and in view of the submissions as made by the learned counsel for the applicants/defendants, the application is allowed and the delay of 242 days in filing of appeal is condoned.
