THE HONOURABLE SRI JUSTICE T.C.D.SEKHAR WRIT PETITION NO: 18069 OF 2025
ORDER: The petitioner is fair price shop dealer of shop No.0812016 of Kunchepalli Village, Podili Mandal, Prakasam District. It is the case of the petitioner that he was appointed as fair price shop dealer about 25 and distributing the essential commodities to the years ago cardholders without any complaints. It is further stated that the respondents are making efforts to bifurcate the fair price shop of the petitioner without issuing notice to him and without calling for objections as per Circular vide CCS.Ref.No.N021/1/2024, dated 18.10.2024 issued by the Commissioner of Civil Supplies. It is further case of the petitioner that as per G.O.Ms.No.10, dated 03.09.2024, the Commissioner Civil Supplies is proposed to optimize the rice cards to be allotted to fair price shops having more than 800 cards in a shop by duly following the existing norms indicated in G.O.Ms.No.35, dated V
17.09.2007. It is the specific case of the petitioner that at present there are 784 cardholders with the petitioner’s fair price shop. Therefore, in view of the Circular coupled with the governmental order in G.O.Ms.No.10, dated 03.09.2024, the respondents cannot bifurcate the petitioner’s fair
2. price shop. On the other hand, the learned Assistant Government Pleader for Civil Supplies would submit that there is no proposal of bifurcation

4 -c^ of the petitioner’s fair price shop, as per instructions, dated 16.07.2025 furnished by the 4*^ respondent, and in case there is any proposal, the respondents would certainly follow the guidelines issued under Circular, dated 18.10.2024 and the petitioner would be put on notice. The instructions dated 16.07.2025 furnished by the 4'*^ respondent is placed on record. In view of the above, the present Writ Petition is closed by placing the instructions, dated 16.07.2025 on record. It is needless to mention that if there is any proposal in future for bifurcation of petitioner’s fair price shop, the respondents shall follow the procedure contemplated under Circular, dated 18.10.2024 and G.O.Ms.No.10 dated 03.09.2024 scrupulously. There shall be no order as to costs.
4. As a sequel thereto, miscellaneous petitions pending, if any. shall stand closed.
