The parties to the Appeal Suit in A.S.No.198 of 2022 and Cross Objection No.95 of 2024 mutually agreed and entered into a compromise in the partition suit. 1. The joint memorandum of compromise has been filed before this Court. All the parties to the Appeal Suit and the Cross Objection signed the joint compromise memo except respondents 11 and 12 inA.S.No.198 of 2022. 2. As far as respondents 11 and 12 are concerned, they are defendants Nos.14 and 15 in the Original Suit. Admittedly, the respondents 11 and 12 in the Appeal Suit are the third parties purchased the property. The other parties to the lis on hand have been agreed to protect the rights of R11 and 12, more specifically in paragraph No.(5) and (6) of the joint memorandum of compromise. Since the sale of property in favour of respondents 11 and 12 are protected by contesting parties, the learned counsel for respondents 11 and 12 have no objection for recording the joint compromise memo. 3. Pursuant to the joint compromise memo between the parties, the defendants in the suit filed a separate joint memorandum of compromise fixing their respective shares in respect of the portion of the land allotted exclusively https://www.mhc.tn.gov.in/judis ASNo.198of2022 for the defendants. Therefore, the plaintiff in the original suit has no objection for allotting shares amongst the defendants in respect of the portion of the property allotted to them in the Schedule B in the joint memo of compromise between all parties (except respondents 11 and 12). 4. Since the parties fully agreed to accept the respective shares allotted as per the join compromise memo between all the parties and joint compromise memo amongst the defendants themselves exclusively, the Appeal Suit and the Cross Objection are decreed in terms of the two joint compromise memorandums, first one among all the parties, except respondents 11 and R12 and the second one amongst the defendants in the suit to share the properties amongst themselves as per the allotment of properties in Schedule B in the common joint compromise memo filed. 5. 5.
