Non-applicants have no objection, if in case, the present application is allowed. Respondent No.37-Ram Lal, is stated to have died on 19.08.2024. The same is evident from the death certificate appended along with the application. From a perusal of the impugned judgments, it is evident that respondent No.37, had been proceeded against ex parte, both before the learned trial Court and the First Appellate Court. No written statement has been filed on behalf of respondent No.37, before the learned trial Court. In view thereof, present application is allowed and applicants/appellants are exempted from bringing on record the legal heirs of deceased respondent No.37 on record. Application stands disposed of.
