03/ 16.09.2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners are apprehending their arrest in connection with Complaint Case No. 1310 of 2016, registered for the offences under Section 33 of the Indian Forest Act, pending in the court of learned Judicial Magistrate, 1st Class, Chatra.

Learned counsel appearing for the petitioners submits that the petitioners have been falsely implicated in this case and the even

the petitioners have not encroached any forest land of plot No. 892 of the forest department. He submits that the names of the petitioners have been taken by the forest guard. He also submits that the petitioners are having no criminal antecedent and disclosure to that effect has been made in para-14 of the petition.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are there against the petitioners of encroaching the forest area and cutting of mahua tree.

Considering that the petitioners are having no criminal antecedent and disclosure to that effect has been made in para-14 of the petition and it has been pointed out that the encroachment has not been made by the petitioners upon the forest land, I am inclined to provide the privilege of anticipatory bail to the petitioners.

Accordingly, the petitioners, named above, are hereby
directed to surrender before the learned court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Chatra, in connection with Complaint Case No. 1310 of 2016, subject to the conditions as laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
