1. Heard Mr. M. Talukdar, learned counsel for the petitioner. Also heard Mr. P. Borthakur, learned Additional Public Prosecutor for the State. 2. This is an application under Section 482 BNSS, 2023 praying for grant of pre-arrest bail to the accused/petitioner, namely, (i) David Kalita, in connection with Gorchuk P.S. Case No. 214/2025 registered under Sections 306/316(4)/318(4) of the BNS, 2023, corresponding the G.R No. 3520 vide G.D.
Page No.# 3/4 No.30 dated 02.07.2025. 3. The case arose out of an FIR dated 02.07.2025, lodged by one Daljit Singh Sodhi with the allegation that a cheque amount of Rs.8,04,500/- given by one of his customers with only the cheque amount filled and other particulars left blank, stolen by his employee David Kalita i.e. the present petitioner, who later encashed the cheque and took the money in his own account. 4. The case diary has been received. 5. The petitioner was granted interim bail on 01.09.2025. 6. It is further submitted by the learned Additional Public Prosecutor for the State that pursuant to grant of interim, the petitioner has appeared before the I.O and his statements have been recorded. 7. It is submitted by the learned prosecution that the copies of the bank statements procured during the investigation indicate receipt of similar amounts in the account of the petitioner. 8. Perused the statement of the accused, recorded by the I.O pursuant to his being granted interim bail. 9.
Considering the progress of investigation and the co- operation rendered by the petitioner; despite the adverse materials, I am not inclined to cancel the interim bail and accordingly, the same is made absolute subject to the conditions that – i) He shall render co-operation to remaining investigation;
Page No.# 4/4 ii) He shall not hamper or tamper with evidence; iii) He shall be available for facing the trial, if one commences
