1. Petitioner-complainant herself has preferred this criminal misc. petition under Section 528 BNSS seeking to quash FIR No. 164/2025, registered at Police Station Malviya Nagar, District Jaipur City (East) for the offences under Sections 115(2), 126(2), 189(2) and 140(3) of BNS. 2. Counsel appearing on behalf of the petitioner-complainant admits that there was some dispute between the parties in respect of money transactions and an FIR was lodged under misconception of correct facts. Indeed, respondents-accused persons never tried
[2025:RJ-JP:29792] (2 of 2) [CRLMP-4506/2025] to abduct petitioner’s cousin Vinit Kevat and now the correct facts have come to fore, hence, petitioner does not want to prosecute the accused respondents and seeks to quash the FIR and investigation thereupon. 3. From the record, it appears that complainant and accused persons appeared in person before this Court on the previous date
24.07.2025. The signatures of the accused persons, duly identified by the respective counsels, are available on record. Photocopy of compromise between the petitioner and the accused persons has also been placed on record. 4. Considering the nature of allegations and offences under which the impugned FIR has been registered as also in view of the fact that since the petitioner-complainant herself does not want to prosecute the respondents- accused persons, this Court is of the considered view that there is no purpose to continue the investigation or criminal proceedings under the impugned FIR. Respondents-accused persons have already been released on bail. 5.
In view of the facts and circumstances of the case, this Court deems it just and proper to exercise its inherent power under Section 528 BNSS and consequently, FIR No. 164/2025, registered at Police Station Malviya Nagar, District Jaipur City (East), alongwith all consequential proceedings, is hereby quashed. 6. Accordingly, the instant Criminal Miscellaneous Petition stands disposed of. 7. Stay application and pending applications(s), if any, also stand(s) disposed of. (SUDESH BANSAL),J pcg/43
