Biswas, learned counsel for the petitioner. Also heard Mr. P. Borthakur, learned Additional Public Prosecutor for the state respondent. 2. By invoking the provisions of Section 482 of the BNSS, 2023 the accused- petitioner, namely, Sanjoy Das is seeking anticipatory bail in connection with Page No.# 2/3 PRC Case No.4442/2024 corresponding to Silchar P.S. Case No.541/2022 registered under Section 366 IPC. 3. The allegation made in the FIR is about taking away the daughter of the informant. 4. After completion of investigation resulted in a charge sheet against the petitioner as sole accused, indicating him as an absconder. Charge sheet was filed under Section 366 IPC vide Charge Sheet dated 30.06.2024. It is stated in the charge sheet by the I.O. that the accused was found to be a married person. The girl was recovered. 5. The scanned copy of the case diary has been received. 6. Perused the statement of the girl recorded before the learned JMFC, Silchar, in which she has stated about her love affairs with him followed by relationship on multiple occasions. However, she has made some other implications against him. 7. Although there are some incriminating materials against the petitioner, but considering the stage of investigation, no purpose would be served by detaining the accused-person in custody and he can be granted bail subject to the suitable conditions. 8. Considering the above, it is hereby directed that in the event of arrest of the petitioner, namely, Sanjoy Das in connection with PRC Case No.4442/2024 corresponding to Silchar P.S. Case No.541/2022, he shall be allowed to go on bail of bail of ₹30,000/- with one surety of the like amount to the satisfaction of the arresting authority, subject to the following suitable conditions :- (a) He shall appear before the learned CJM, Silchar on each and every dates and shall be available for trial, if one commences; Page No.# 3/3 (b) He shall not hamper or tamper with evidence. (c) He shall not in any manner harass or intimidate or harm the witnesses/the informant or her family members. Violation of the conditions will entail cancellation of bail. 9.
