2.
The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 96, 64(2), 74, 351 (2), 3(5) of B.N.S. 2023 and under Section 4 & 8 of POCSO Act, 2012 in connection with Special POCSO Case No.04 of 2025.
3.
Learned counsel for the petitioner submits that in view of the deposition of the victim i.e., P.W.-1 at para-9 who could not identify the petitioner and also the deposition of the other witnesses fairly indicates that the petitioner has falsely been implicated in the case. He further submits that there is no specific allegation against the petitioner. He further submits that the petitioner has no criminal antecedents and for no offence he has been languishing in custody since 28.02.2025; as such, the petitioner may be enlarged on bail. He submits that the petitioner is ready to abide by every condition as imposed by this court.
4.
Learned A.P.P. opposes the prayer for bail of the petitioner.
5.
Having regard to the facts of the case coupled with the statement made by P.W.-1 at para-9 of her deposition; I am inclined to enlarge this petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge POCSO Act, Dumka in connection with Special POCSO Case No.04 of 2025.
6.
It is made clear that the petitioner shall appear on each and every date before the learned trial court and he shall not threaten any witnesses and shall co- operate in trial and if any adverse report will come against this petitioner, learned trial court shall be at liberty to cancel the bail of this petitioner.
