1. Prelude:- 1.1 With the consent of learned counsel representing the parties, a batch of 249 regular first appeals filed for modification in the market value of the acquired land assessed by the Reference Court (RC), detail whereof is given at the foot of the judgment, shall stand disposed of by this common
order. 1.2 Relevant and important details of the acquisition are as under:- 29.07.2010 Notification under Section 4 of the Land Acquisition Act, 1894, was issued for proposing to acquire land in Village Gorkhpur, Badopal and Kajalheri, District Fatehabad for construction of 2,800 MW, Gorakhpur, Atomic Power Project. 25.07.2011 Declaration under Section 6 of the Land Acquisition was published. 18.07.2012 By three separate awards the Land Acquisition Collector, assessed the market value of the acquired land @ Rs.20 lacs per acre for all kinds of land alongwith all statutory benefits. 20.10.2015 Reference Court assessed the market value of the acquired land @ Rs.29,04,000/- per acre. 23.01.2020 The High Court remitted the matter back to the Reference Court for permitting the parties to lead further evidence. 18.11.2022 Reference Court has assessed the market value of the acquired land @ Rs.29,06,670/- per acre.

RFA-1255-2023 (O&M) & other connected cases -3- 2.1 The land owners as well the beneficiary of the acquisition, namely, the Nuclear Power Corporation of India Limited (hereinafter referred to as ‘NPCIL’) have filed the appeals challenging the assessment of market value. The owners claimed enhancement, whereas, NPCIL claims reduction in the market value assessed by the RC. 2.2 While filing the petitions under Section 18 of the Land Acquisition Act, 1894, the land owners claimed that the market value of the acquired land was not less than Rs.1 crore per acre because the land was yielding two crops and most of the acquired land was nehri (canal irrigated). They also claimed that the acquired land has great potential to be utilized for residential and commercial purpose, hence, the market value assessed by the Land Acquisition Collector (hereinafter referred to as ‘LAC ’) is incorrect. Arguments Addressed:- 3.1 Besides oral submission, Sh. M.L. Sharma, learned counsel representing the land owners has also filed detailed written submissions. The relevant extract of which is extracted herebelow:- I. RW/1-Sh. Ram Singh, District Revenue Officer-cum- Land Acquisition Collector has admitted that value potentiality and comparability of land of villages Kumharia, Badopal and Gorakhpur are similar for all intents and purposes. II. Deduction of 75% on the price of land vide sale deeds Ex.P-7 and P-13 to arrive at a market value of the acquired land is exorbitant and it is unreal. III The location of the acquired land categorically proves that apart from sale deeds there were other documents which could form basis to assess the market value of the acquired land. IV. With respect to acquisition of land in villages Dhanger and Bhadopal for minor irrigation, the notification under Section 4 of the Act was issued in 2013. In these two villages, the Court has assessed the market land of the acquired land @ Rs.58,08,000/-. Learned counsel has claimed that the Court should rollback the price to assess the market value @ NEERAJ 2025.03.28 17:24 I attest to the accuracy and integrity of this document

Similarly, the acquisition of land for bypass of villages Dhanger and Fatehabad was issued in 2008 while assessing the market value @ Rs.50,00,000/- per acre. V. Sh. Ashish Aggarwal, learned senior counsel representing some of the land owners has filed an application for additional evidence in RFA-535-2023 to produce photographs of the parcel of land sold vide sale deed Ex. P-7. He submits that development work of the acquired land was not required because the acquisition was not for a colony. Hence, no development cut could be imposed. The RC has also not recorded reasons to apply the maximum cut i.e. 75%. Other learned counsels representing the land owners have adopted the aforesaid arguments. 3.2 Per contra, Sh. Ashish Chopra, learned senior counsel representing NPCIL submits that the RC has erred in ignoring sale instance Ex. R/28, though, it was executed on the same date i.e. 29.07.2010 with respect to 1 acre of land in village Gorakhpur. He further submitted that 'no litigation incentive' @ 20% should not be included while assessing of the market value.
He further submitted that the sale instance Ex.P-7 is with respect to a very small plot located in different village, namely, Kumharia, hence, it was not appropriate to rely upon the same. 4.

The RC has refused to rely upon various letters namely, Ex. P-22 to P-25 and assessment of market value by LAC or Courts with respect to period post 29.07.2010. Similarly, judgment Ex.P-11, P-59 have not been followed as the acquired land in those cases was not comparable with the acquired land in this case. Thereafter, the RC proceeded to assess the market value of the acquired land on the basis of a sale deed of 03 marlas plot located in village Kumharia, executed on 24.09.2009 for Rs.2,00,000/-. The total area of 03 marlas comes to 90.75 sq. yard, whereas, the total area of an ordinary acre is 4840 sq. yard (08 kanals). The area of each kanal is 605 sq. yard. 20 marlas is equivalent to 01 kanal land. An area of each marla is 30.25 sq. yard. In this case, the acquisition is of the total land measuring nearly 1500 acres (mere 72,60,000 sq. yard). 4.3 On a bare look at the various lay out plans, it becomes evident that the majority of the acquired land is in village Gorakhpur, whereas, a small pocket of land is located in village Kajalheri. Thereafter, there is another parcel of land acquired in village Badopal. The residential area of village Badopal is located near Hisar-Fatehabad road, which is also known as National Highway No.9. The acquired land in Badopal is on Kajalhedi village road and is at a sufficient distance far away from the National Highway. Once, we travel on Kajalheri road towards western direction, the residential area of village Kajalheri is further ahead towards west side. From village Kajalheri one has to go to village Gorakhpur either through the acquired land or through village Kumharia. In fact village Gorakhpur is close to Rajasthan border. RFA-1255-2023 (O&M) & other connected cases -14- of the record, it is evident that some part of the land is cultivable, whereas, most of the land is either in the shape of plain or molds of sand. 4.4 This Court has carefully read the statement of RW/1-Sh.
Ram Singh, District Revenue Officer-cum-Land Acquisition Collector, Fatehabad. He has stated that value potentially and comparability of land of village Kumharia, Badopal and Gorakhpur is similar for all intents and purposes. village Kumharia is also located at a sufficient distance from National Highway and in fact residential area of village Kajalheri, Kumharia and Gorakhpur form a triangle. From village Kajalheri one has to travel towards north to reach village Kumharia. There is no reason to doubt the correctness of the statement of RW/1-Sh. Ram Singh, District Revenue Officer-cum-Land Acquisition Collector. 4.5 With respect to market value of the acquired land assessed for acquisition of land for minor irrigation situated in villages Dhanger and Badopal, it would be noticed that the aforesaid land was acquired in the year 2013 i.e. three years after the notification on 29.07.2010 was issued in the present case. 4.6 Similarly, It would not be appropriate to assess the market value of the acquired land the acquisition of land for construction of bypass of village Dhanger and Fatehabad because those are located on the National Highway, whereas, the acquired land is located in the interiors and at a great distance. 4.7 Similarly, there is no substance in the argument of Mr. Aggarwal because even if the photographs are taken into consideration, a very small plot NEERAJ 2025.03.28 17:24 I attest to the accuracy and integrity of this document
RFA-1255-2023 (O&M) & other connected cases -15- of 91 sq. yard has been sold. Hence, the plot of 91 sq. yard is not comparable for assessing the market value of 1500 acres of land. The question of development cut shall be analyzed in the later part of the judgment. 4.8

RFA-1255-2023 (O&M) & other connected cases -18- 4.9 From perusal of the table, it is evident that the land owners have produced the sale deeds Ex. P-9 dated 25.10.2012 with respect to 28 kanals land in village Gorakhpur, Ex.P-31 dated 05.06.2008 with respect to 01 kanal gair mumkin land in village Kajalheri. Remaining sale deeds are pertaining to village Kumharia, Khara Kheri, Matana, Dhanger and Basti Bhiwan. Ex. P-9 dated 25.10.2012, is executed post issuance of notification under Section 4 of the Act. In fact, this sale deed has been executed on 29.07.2010 more than two years after the date of notification under Section 4 of the Act. The sale instance Ex.P-31 dated 05.06.2008 is with respect to non-agricultural land because the land has been described as gair mumkin. It is either for residential or for commercial purpose. Hence, it is not a good exemplar to assess the market value of agricultural land. 4.10 On careful perusal of Lower Court Record, it becomes evident that notification under Section 4 of the Act proposing to acquire the land on 29.06.2010 is part of the record. Ex. R-7 dated 05.11.2009 is a sale instance of 142 kanals 14 marlas nehri land located in village Gorakhpur sold at a total price of Rs.1,5,94,500/-. On its careful perusal, it becomes evident that out of 142 kanals 14 marlas, 102 kanals 14 marlas was nehri (canal irrigated), whereas, 40 kanals was plain but uncultivable land. The land has been described as 'tal' that means ground. The land fit for agriculture has been sold @ Rs. 6,50,000/- per acre, whereas, uncultivable land has been sold for Rs.4,50,000/- per acre. This sale instance is out of land comprised in rectangle No. 379, khasra Nos.2, 3, 8, 9, 10 and rectangle No. 380 khasra Nos.

RFA-1255-2023 (O&M) & other connected cases -19- 11, 12, 14, 17, 18, 19, 20, 21, 22. This entire land is subject matter of acquisition in the present case. In other words, cultivable and non-cultivable land was being sold @ Rs.6,50,000/- and Rs.4,50,000/- respectively in the year November 2009, which is just nine months before the notification under Section 4 of the Act. Similarly, with respect to village Badopal, the relevant sale instance is Ex.R-55 dated 04.02.2008 with respect to land measuring 13 kanals 05 marlas. 7/18th share of 34 kanals 11 marlas land comprised in rectangle No. 186, khasra nos.18,19,20,21 and 15/1 have been sold. The land comprised in rectangle No. 186 Khara Nos. 18, 19, 20, 21 has been acquired. This parcel of land has been sold @ Rs.3,75,000/- per acre on 04.02.2008. 4.11 Once, the NPCIL has produced sale instances of the acquired land itself, it was not appropriate for the RC to rely upon the sale instance of a very small tiny plot of 91 sq. yard located in different village i.e. Kumharia. It is evident that the beneficiary of the acquisition has produced as many as 31 sale deeds, which show that even before or after the date of notification under Section 4 of the Act, the market value of the land in villages Gorakhpur, Kajalheri or Badopal was nowhere near Rs. 25,00,00/- as already awarded by the Land Acquisition Collector. In fact, if we carefully examine the tabulated compilation, it appears that on 05.04.2011,17 kanals 06 marlas land was sold @ Rs.12,00,000/- per acre in village Gorakhpur. Similarly, on 14.06.2011, 15 kanals 03 marlas uncultivable land was sold @ Rs. 9,00,000/- per acre. Similar is the position of sale instance dated 22.03.2011.
In village Badopal, sale instances Exhibits R/57, 58 and 60 prove that even after issuance of NEERAJ 2025.03.28 17:24 I attest to the accuracy and integrity of this document
RFA-1255-2023 (O&M) & other connected cases -20- notification under Section 4 of the Act, the price of the land was nowhere near Rs.20,00,000/- per acre. It was not appropriate for the RC to ignore the sale instances produced by the NPCIL on the basis of Section 25 of the Land Acquisition Act, 1894 (hereinafter referred to as ‘of the Act’). In fact, the Court has erred in interpreting Section 25 of the Act, which nowhere prohibits taking into consideration the sale deeds reflecting lower price than the market value assessed by the Land Acquisition Collector while assessing the market value. This issue is no longer res integra in view of judgment passed by the Supreme Court in 'Lal Chand vs. Union of India and others', (2009) 15 SCC 769
. The Supreme Court in Chimanlal Hargovinddass Vs. Special Land Acquisition Officer, Poona, (1988) 3 SCC 751 has laid down following 17 tests for assessing the market value:-
“4. The following factors must be etched on the mental screen: (1) A reference under Section 18 of the Land Acquisition Act is not an appeal against the award and the court cannot take into account the material relied upon by the Land Acquisition Officer in his award unless the same material is produced and proved before the court. (2) So also the award of the Land Acquisition Officer is not to be treated as a judgment of the trial court open or exposed to challenge before the court hearing the reference. It is merely an offer made by the Land Acquisition Officer and the material utilised by him for making his valuation cannot be utilised by the court unless produced and proved before it.
It is not the function of the court to sit in appeal against the award, approve or disapprove its reasoning, or correct its error or affirm, modify or reverse the conclusion reached by the Land Acquisition Officer, as if it were an appellate court. (3) The court has to treat the reference as an original proceeding before it and determine the market value afresh on the basis of the material produced before it. (4) The claimant is in the position of a plaintiff who has to show that the price offered for his land in the award is NEERAJ 2025.03.28 17:24 I attest to the accuracy and integrity of this document
RFA-1255-2023 (O&M) & other connected cases -21- inadequate on the basis of the materials produced in the court. Of course the materials placed and proved by the other side can also be taken into account for this purpose. (5) The market value of land under acquisition has to be determined as on the crucial date of publication of the notification under Section 4 of the Land Acquisition Act (dates of notifications under Sections 6 and 9 are irrelevant). (6) The determination has to be made standing on the date line of valuation (date of publication of notification under Section 4) as if the valuer is a hypothetical purchaser willing to purchase land from the open market and is prepared to pay a reasonable price as on that day. It has also to be assumed that the vendor is willing to sell the land at a reasonable price. (7) In doing so by the instances method, the court has to correlate the market value reflected in the most comparable instance which provides the index of market value. (8) Only genuine instances have to be taken into account.
(Sometimes instances are rigged up in anticipation of acquisition of land.) (9) Even post-notification instances can be taken into account (1) if they are very proximate, (2) genuine and (3) the acquisition itself has not motivated the purchaser to pay a higher price on account of the resultant improvement in development prospects. (10) The most comparable instances out of the genuine instances have to be identified on the following considerations: (i) proximity from time angle, (ii) proximity from situation angle. (11) Having identified the instances which provide the index of market value the price reflected therein may be taken as the norm and the market value of the land under acquisition may be deduced by making suitable adjustments for the plus and minus factors vis-à-vis land under acquisition by placing the two in juxtaposition. (12) A balance-sheet of plus and minus factors may be drawn for this purpose and the relevant factors may be evaluated in terms of price variation as a prudent purchaser would do. (13) The market value of the land under acquisition has thereafter to be deduced by loading the price reflected in the NEERAJ 2025.03.28 17:24 I attest to the accuracy and integrity of this document
RFA-1255-2023 (O&M) & other connected cases -22- instance taken as norm for plus factors and unloading it for minus factors. (14) The exercise indicated in clauses (11) to (13) has to be undertaken in a common sense manner as a prudent man of the world of business would do.
We may illustrate some such illustrative (not exhaustive) factors: Plus factors Minus factors 1 smallness of size 1 largeness of area 2 proximity to a road 2 situation in the interior at a distance from the road 3 frontage on a road 3 narrow strip of land with very small frontage compared to depth 4 nearness to developed area 4 lower level requiring the depressed portion to be filled up 5 regular shape 5 remoteness from developed locality 6 level vis-à-vis land under acquisition 6 some special disadvantageous factor which would deter a purchaser 7 special value for an owner of an adjoining property to whom it may have some very special advantage (15) The evaluation of these factors of course depends on the facts of each case. There cannot be any hard and fast or rigid rule. Common sense is the best and most reliable guide. For instance, take the factor regarding the size. A building plot of land say 500 to 1000 sq. yds. cannot be compared with a large tract or block of land of say 10,000 sq. yds. or more. Firstly while a smaller plot is within the reach of many, a large block of land will have to be developed by preparing a lay out, carving out roads, leaving open space, plotting out smaller plots, waiting for purchasers (meanwhile the invested money will be blocked up) and the hazards of an entrepreneur. The factor can be discounted by making a deduction by way of an allowance at an appropriate rate ranging approximately between 20 per cent to 50 per cent to account for land required to be set apart for carving out lands and plotting out small plots. The discounting will to some extent also depend on whether it is a rural area or urban area, whether building activity is picking up, and whether waiting period during which the capital of the entrepreneur would be locked up, will be longer or shorter and the attendant hazards.

RFA-1255-2023 (O&M) & other connected cases -23- (16) Every case must be dealt with on its own fact pattern bearing in mind all these factors as a prudent purchaser of land in which position the judge must place himself. (17) These are general guidelines to be applied with understanding informed with common sense.” 4.13 It is evident that the Court was required to identify sale deed of comparable sale instance with respect to value, location, potentiality and quality of land during contemporaneous period with that of the acquired land included in notification under Section 4 of the Act. Hence, reliance by the RC on Ex. P-7 was inappropriate and not justified. 4.14 Similarly, reliance placed by the RC on judgment of the Supreme Court in 'Special Land Acquisition Officer vs. Karigowda & Ors., and others, 2010 (5) SCC 708, is also wholly misplaced because it has been held by the Supreme Court that the parcels of comparable land of adjacent villages can be taken into consideration. However, this judgment does not lay down that the sale instances of the acquired should be ignored, whereas, the sale instances of parcels of land which are not comparable with the acquired land should be relied upon. In fact while assessing the market value of the acquired land, the Court is required to sit on the chair of a prudent purchaser and then proceed to assess the market value on the basis of entire evidence produced by the parties. No doubt some latitude has to be given to the land owners who stand deprived of their livelihood. However, while assessing the market value the Court is not expected to Award amount more than the market value. First part of Section 23(1) of the Land Acquisition Act, 1894 provide for assessment of market value of the acquired land at the date of publication of notification under NEERAJ 2025.03.28 17:24 I attest to the accuracy and integrity of this document
RFA-1255-2023 (O&M) & other connected cases -24- Section 4 of the Act.
In Lal Chand's case (Supra), the Supreme Court laid down 17 tests, which should be applied by the Court before assessing the market value of the acquired land. In this case, the Court has failed to apply those 17 tests which were laid down for the guidance of the Courts for assessing the market value of the acquired land. If the Courts apply all the tests, the chances of error can be reduced. It is expected that the Courts will keep the aforesaid tests into consideration while proceeding to assess the market value of the acquired land in future. The sale instance Ex. R-7 is with respect to around 18 acres of land, which is a large compact block of parcel of land. The sale deed includes cultivable as well as non-cultivable land. Similarly, sale instance Ex. R-55 of 13 kanals 05 marlas land located in Badopal is also of more than 1½ acres. Once, sales exemplar of comparable parcels of land during contemporary period were available, the RC ought to have avoided reliance upon the sale instance Ex. P-7 which is of a tiny parcel of land located in different village. 4.15 The RC has also erred in taking into consideration 'no litigation incentive' @ 20% upon the basic market rate. This incentive is given to only those land owners who do not indulge in litigation. The same could not be taken into account while assessing the market value of the acquired land. The RC has correctly observed that the judgments of the Courts/Awards of the LAC Ex. P11, P12, P-19, P-32, P-33, P-42, P-43, P-44, P-45 and Judgments in RFA- 4247-2016 decided on 08.01.2020, RFA-9626-2014 decided on 22.09.2015 will not help the Court in assessing the market value of the acquired land.
Now, NEERAJ 2025.03.28 17:24 I attest to the accuracy and integrity of this document
RFA-1255-2023 (O&M) & other connected cases -25- as far as argument of learned counsel representing the land owners with respect to cut on account of development is concerned, the same does not arise for
consideration because this Court has found that sale instances Ex. R/7 and R/55 are with respect to the acquired land. Hence, percentage of cut/deduction/question of rolling back does not arise in the present case.
5. Decision:- 5.1 Keeping in view aforesaid discussions, the Awards passed by the Reference Court on 18.11.2022 and 20.10.2015 shall stand set aside. Hence, all the reference petitions shall stand dismissed. 5.2 Consequently, the appeals filed by NPCIL shall stand allowed, whereas, that of the land owner shall stand dismissed. 5.3 All the pending miscellaneous applications, if any, are also
