CHAKRAVARTHI WRIT PETITION NO:17142 of 2019 The Court made the following Order: Heard learned counsel for the petitioner and learned Additional Government Pleader representing the State. 2. Learned Additional Government Pleader on written instructions would submit that several cases were registered against the petitioner and a suspect sheet was also opened against the petitioner, for involving in excise offences. He would further submit that the allegations made in the affidavit are not true and correct and the Police never harassed the petitioner, as alleged in the present Writ Petition. 3. The contention of the Petitioner is that respondent No.4 and his staff harassed the petitioner and beat him. Thereupon, the petitioner approached respondent No.3 Circle Inspector but he did not take any action against respondent No.4. Later the petitioner submitted a representation to respondent No.2 through registered post, but no action was taken. 4. The contention of the respondents is that the petitioner made false allegations and they never harassed the petitioner, as alleged in the affidavit. 4 5. To find out the truth or otherwise on the factual issue, it require a detailed enquiry which cannot be made by this Court under Article 226 of the Constitution of India. Now in the State of Andhra Pradesh, the District Police Authorities are constituted to enquire into the misconduct alleged against the police officers. Therefore, the Petitioner is at liberty approach the District Police Authority, Guntur regarding the alleged misconduct committed by respondent No.4 and his staff for the petitioner. If the Petitioner present any application to the District Police Authorities, Guntur, such authority shall enquire into the matter in accordance with the law and submit a report to the Government, for further action. 6.
