Heard the parties.
The petitioner has been made accused in connection with Untari Road P.S. Case No. 21 of 2023, for the offences registered under Sections 302/201/120-B of the Indian Penal Code, pending in the court of learned C.J.M., Palamau at Daltonganj.
On 06.09.2023 at about 05:00 A.M, the son of the informant namely Shivpati Kumar was found hanging. Suspicion has been raised upon the petitioner and other co-accused persons that they might have committed the murder of the deceased.
Learned counsel for the petitioner has submitted that apart from suspicion and the confession of co-accused and confession of this petitioner, there is no other material against him. It was further submitted that co-accused Guddu Rejwar has been granted bail by this Court in B.A. No. 3573/2024 and the case of the petitioner stands on similar footing.
Learned A.P.P on behalf of the State has opposed the prayer for bail but does not dispute the aforesaid fact.
In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned C.J.M., Palamau at Daltonganj, in connection with Untari Road P.S. Case No. 21 of 2023.
