The petitioner has been made accused in connection with S.T. Case No. 413/2023 arising out of Muffasil P.S. Case No. 59/2023, for the offences registered under Sections 302/34 of the I.P.C. and Sections 25(1-B)a, 26, 27 & 35 of the Arms Act, pending in the Court of Sri Kumar Pawan, learned A.D.J.-II, Hazaribagh. 3. Bail application of the petitioner was earlier rejected by this Court in B.A. No. 406/2024 vide order dated 03.05.2024. 4. It is alleged that on 09.03.2023, the petitioner had shot dead the nephew of the informant namely Prince Kumar. Some of the passersby were also injured due to indiscriminate firing. The petitioner was apprehended at the spot by the villagers. 5. Report regarding the stage of trial, earlier called for, has been received. It appears that three prosecution witnesses have been examined so far. 6. Considering the nature of allegation and the fact that trial is under progress, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected.
