1. The applicant who is in custody since 23.05.2025 has approached this Court for grant of regular bail in connection with Special POCSO Case No.32 of 2025 arising out of Basia P.S. Case No.42 of 2025, registered for the offence under Sections 64/ 62 of B.N.S., 2023 and Sections 8/ 12 of the POCSO Act, pending in the court of learned Exclusive Special Judge POCSO Court-cum-Additional Sessions Judge-IV, Gumla.
2. It has been submitted by learned counsel for the applicant(s) that complete set of F.I.R. alongwith its enclosure have been annexed with this bail application and there is no suppression on his/her part.
3. Innocence has been claimed and undertaking has been given for participation in the trial. It has been submitted by the learned counsel for the applicant that neighbourhood dispute has been converted into present criminal case. It has been further submitted that as per the allegation it is an attempt only. On above basis prayer for bail has been made.
4. Learned A.P.P. has opposed the prayer for bail of the applicant.
5. Considering the materials available on record, I am inclined to enlarge the applicant on bail. Accordingly, the applicant, named above, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge POCSO Court-cum-Additional Sessions Judge-IV, Gumla in connection with Special POCSO Case No.32 of 2025 arising out of Basia P.S. Case No.42 of 2025, subject to condition that the applicant will submit self-attested copy of his Aadhaar Card and also give his mobile number before the learned trial court which he will not change during pendency of this case without prior permission of the court.
