No. 442 situated at Ratnagiri Revenue Village, Rolla Mandal, Sri Satya Sai District is as illegal, arbitrary and violative of article 14, 21 and 300- A of the constitution of India and contrary to the provisions of the A.P. Rights in Land for Issuance of Pattadar Pass Book and Title Deed Act, 1971 and rules made their under and consequently conclude the enquiry pursuant to above said notice and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the 4th respondent to conclude the enquiry vide Rc. GP FOR REVENUE The Court made the following: :: ORDER :: The above writ petition has been filed to declare the action of respondent No.4 in not concluding the inquiry, in pursuance of the notice dated 02.02.2024 (Ex.P1) in respect of Ac.5.68 cents in Sy.No.442 of Ratnagiri Revenue Village, Rolla Mandal, Sri Satya Sai District, as illegal and arbitrary. Page 3 of 4 SRS,J W.P.No.18422 of 2025 2. Heard Sri V. Jagadeesh, learned counsel representing Sri P. Narasimhulu, learned counsel for the petitioners and Sri G. Divya Theja, learned Assistant Government Pleader for Revenue, appeared for respondents 1 to 4. 3. Today, when the matter is taken up for consideration, learned counsel for the petitioner would submit that the Tahsildar issued an endorsement vide Rc.No.05/2024, dated 23.07.2025. He would also submit that the petitioner must avail an appropriate remedy. The same is recorded. 4. In reply, learned counsel for the petitioner would submit that the petitioner will avail alternative appropriate remedy. 5. Given the facts and circumstances of the case, without touching the merits of the matter, the Writ Petition is disposed of at the stage of admission with the consent of both the learned counsel, giving liberty to the petitioner to avail an appropriate remedy, in pursuance of an endorsement issued by the Tahsildar vide Rc.No.05/2024, dated 23.07.2025. No order as to costs.
