The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 20(b)(ii)(c), 29 of the NDPS Act.

Learned counsel for the petitioner submits that petitioner is innocent and no incriminating article has been recovered from his possession. There is no independent witness to implicate the petitioner in recovery of Ganja from his house. He further submits that petitioner is languishing in custody since 13.07.2025; as such, the petitioner may be enlarged on bail. He is ready to abide by every condition imposed by this court.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Having regard to the facts of the case that the recovery article is in intermediary quantity and no independent witness is there to implicate the petitioner in the said recovery; I am inclined to enlarge this petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Principal District and Session Judge- cum-Special Judge, Lohardaga in connection with Kuru P.S. Case No. 78/2025.

It is made clear that the petitioner shall appear on each and every date before the learned trial court and if any adverse report will come against this petitioner, learned trial court shall be at liberty to cancel the bail of this petitioner.
