At the very outset, learned counsel for the petitioner would submit that an affidavit has been filed by the complainant/respondent No. 2 stating therein that amicable settlement has been arrived in between him and the petitioner. 2. Perusal of the affidavit would that there is no mention of terms and condition for amicable settlement. Even no copy of amicable settlement/compromise deed has been filed.
3. In view of the above, learned counsel for the applicant seeks permission of this Court to withdraw the instant CRMP with liberty to file afresh petition with a copy of amicable settlement/compromise deed.
4. Accordingly, this CRMP is dismissed as withdrawn with the aforesaid liberty granted in favour of the applicant.
