Accused Nos.1 and 2 in Crime No.54/2025 registered by Ramapura Police Station, Chamarajanagar, for the offences punishable under Sections 4 and 5 of the Explosive Substances Act, 1908, Sections 9(B) and 1(b) of the Explosives Act, 1884 and Section 325 of the BNS, 2023, are before this Court under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.54/2025 was registered by Ramapura Police Station, Chamarajanagar, for the aforesaid offences against unknown persons based on the first information dated 31.03.2025 received from Muruga S/o Doddakala. During the course of investigation, petitioners herein were arrested on - 3 - NC: 2025:KHC:18068 CRL.P No. 6515 of 2025 03.04.2025 and in their remand application, they were arraigned as accused Nos.1 and 2. Their bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.5060/2025 was rejected. Therefore, they are before this Court. 4. In the first information that was submitted by Muruga S/o Doddakala, he has stated that on 31.03.2025 when he and other labourers were grazing their cattle, the cattle belonging to them accidentally came in touch with crude bombs which was kept by unknown persons for the purpose of hunting wild boars. During the course of investigation, petitioners herein were arrested on 03.04.2025. Accused No.3 as against whom similar allegations are found has been granted regular bail by the jurisdictional Sessions Court in Crl.Misc.No.5065/2025. Petitioners are rustic villagers who are agricultural labourers by avocation. They do not have any criminal antecedents. The alleged offences are neither punishable with death or with life imprisonment. Considering the nature of allegations found against the petitioners and the background in which criminal case was registered in the present case, I am of the opinion - 4 - NC: 2025:KHC:18068 CRL.P No. 6515 of 2025 that the prayer made by them for grant of regular bail needs to be answered affirmatively. Accordingly, the following order:- 5. The petition is allowed. The petitioners are directed to be enlarged on bail in Crime No.54/2025 registered by Ramapura Police Station, Chamarajanagar, for the offences punishable under Sections 4 and 5 of the Explosive Substances Act, 1908, Sections 9(B) and 1(b) of the Explosives Act, 1884 and Section 325 of the BNS, 2023, subject to the following conditions: a) Petitioners shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioners shall not involve in similar offences in future; - 5 - NC: 2025:KHC:18068 CRL.P No. 6515 of 2025 e) The petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off.
