Judgment & Order (ORAL) (Dr.T.Amarnath Goud, J)
This petition is filed by the petitioner under Section 226 of the Constitution of India, seeking a direction for independent judicial inquiry into the death of late Kailash Roy on 29.06.2025 while he was under judicial custody in Kendriya Sansodhanagar, Bishalgarh, and also for a direction for paying compensation to the family of the deceased for the said custodial death of the deceased.
2. Heard learned counsel appearing for the parties.

Learned counsel for the petitioner has urged this court to direct the respondents to cause the judicial inquiry into the custodial death of the deceased expediously and also has urged for providing compensation to the family members of the deceased.
4. Learned PP has submitted that judicial inquiry has already been initiated and the same is ongoing. In this regard, learned PP has placed a copy of Order dated 14.11.2025 passed by Judicial Magistrate, 1st Class, Court No.2, Agartala, West Tripura, in Case No. Misc. 4529 of 2025.
5. This court has perused the said Order dated 14.11.2025 which clearly reveals that proceeding has already been initiated by the Judicial Magistrate, 1st Class, Court No.2, Agartala, West Tripura, in this regard.
6. In the light of above, this Court is not deciding the matter of judicial side. Insofar as the relief for receiving payment of compensation is concerned, this court is of the view that, since the matter is at the premature stage, thus, this Court is not inclined to express its opinion on the same, and accordingly, the reliefs sought for by the petitioner stand dismissed. However, it is always open for the petitioner to make a claim for compensation, if eligible, at an appropriate time.
7. Accordingly, the instant writ petition stands dismissed to the extent as indicated above. Pending application(s), if any, also stands disposed.
