Heard Mr. B. Purkayastha, learned counsel for the petitioners. Also heard Mr. S. M. T. Chistie, learned Standing Counsel, Secondary Education Department for the respondent Nos. 1, 2 and 4, Mr. B. Deuri, learned Govt. Advocate for the respondent No.3 and Mr. T. C. Chutia, learned Standing Counsel, Assam State School Education Board for the respondent No.5. [2.] Having regard to the nature of grievance projected by the petitioners, the writ petition is taken up for disposal at this stage. [3.] The petitioners are the President and Members of the School Managing Committee of Dakshin Pakowa Bahjani Milan High School, Dehar Kalakuchi in the district of Nalbari and they are aggrieved with the change of the examination centre from the said School to Bagurihati Higher Secondary School. According to the petitioners, the students of Dakshin Pakowa Bahjani
Page No.# 3/3 Milan High School will have to now travel extra 10 to 14 kms to undertake the HSLC examination. According to the petitioners, change of the examination centre is not in the interest of the students concerned and therefore, the petitioners submitted a representation before the Chairmen of Assam State School Education Board by speed post on 21.10.2025.
However, as the representation has not been considered, the petitioners are before this Court. [4.] Mr. T. C. Chutia, learned Standing Counsel, Assam State School Education Board submits that the Board issues guidelines and the parameters for selecting the examination centre and the ultimate selection is done by the District Administration and therefore the Board has no role to play. [5.] Considering the above submission and instead of keeping the writ petition pending before this Court, the same is disposed of by directing the petitioners to submit a representation before the District Commissioner, Nalbari with a copy to the Inspector of Schools, Nalbari within a period of one week from today along with a copy of the writ petition. [6.] On receipt of the said representation by the authorities concerned the same should be considered in accordance with law as per the guidelines and after giving due opportunity of hearing to the applicants as expeditiously as possible and preferably within a period of 15(fifteen) days from the date of receipt of the representations. [7.] With the above directions, the writ petition stands disposed of. JUDGE Comparing Assistant
