PUBLIC PROSECUTOR The Court made the following: ORDER The instant Criminal Petition, under Section 482 of B.N.S.S., 2023 (u/s.438 of the Code of Criminal Procedure, 1973) has been filed by the Petitioner/Accused, seeking to release the Petitioner on bail in the event of their arrest in FIR. No.450 of 2024 for the alleged offence punishable under Sections 7-B r/w 8-A of A.P. Prohibition (Amendment) Act, 2020. 2. The case of the prosecution is that on 26.10.2024 at 3:00 PM, on reliable information, I P & ESI, Rajamahendravaram South along with her staff 2 reached Grama Sachivalayam and requested VRO of Diwancheruvu-IV to act mediator regarding illegal possession of FJ Wash and proceeded with raid party on their jeep No.AP02 TV 0297 and reached the scene of offence i.e., at Sy.No.996,ending of Puntha Road, near Indian Oil Gas Gowdown, left side of Raghunandhapuram to Srikrishnapatnam Road, Raghunadhapuram Village of Rajanagaram Mandal. In the presence of mediator the raid party verified the place and found 500 ltrs of F.J.Wash in 5 Blue coloured Plastic drums each drum containing about 100 Ltrs of FJ Wash which was fit for distillation of I.D liquor. Thereafter, they enquired the coolies and came to know the land belongs to the Accused. Hence the crime. 3. Heard Sri B. Parameshwara Rao, learned counsel for the Petitioner and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor for the State/Respondent. 3. Learned counsel for the petitioner would submit that the nothing is alleged against the petitioner except showing that he is the owner of the land in which FJ Wash was found by the Excise Police. 4. Learned Assistant Public Prosecutor vehemently opposed the petition stating that seven (7) more cases were registered against the petitioner. 5. Learned counsel for the petitioner in reply would submit that the cases registered against the petitioner were ended in acquittal. At this juncture, learned counsel would submit that liberty may be given to the petitioner to surrender before the concerned Court and move a regular Bail application and 3 direction may be given for disposal of such application as expeditiously as possible. 6. Considering the submissions made, since it is not a fit case for exercising the jurisdiction to grant anticipatory bail, the petition is disposed of. However, the petitioner is at liberty to surrender before the concerned Magistrate Court and mover a regular bail application and on filing such application, learned Magistrate may pass appropriate orders according to law as expeditiously as possible. As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed. __________________________________________ DR.
