By this application filed under Section 442 read with Section 438 of the BNSS, 2023, the petitioner has challenged the Order dated 28.08.2025, by Page No.# 2/2 which the custody of the vehicle as well as the cell phone to the petitioner was rejected on the ground that the Police had furnished a report saying that the cell phone was used in the illegal chit fund activities and that his vehicle was bought from the money earned through the said illegal activities. Mr. J.M. Sulaiman, learned counsel for the petitioner submits that the Charge-sheet has been submitted in the instant case and as such, he prays that he may move the required application before the learned Court of Special Judge, FTC, Sribhumi, since, the Order dated 28.08.2025 was at the investigation stage.
