This application has been filed by the applicants for quashing the charge sheet dated 8.5.2017 in Case No. 11 of 2018 (State Vs. Rohdas and others) arising out of Case Crime No. 147 of 2016 under Sections 498-A, 323, 504, 506 I.P.C. and 3/4 D.P. Act, Police Station Fatehganj Paschimi, District Bareilly. 3. Learned counsel for applicants and learned counsel for applicant no. 2 agree that in respect of husband-applicant no. 1 the present application under Section 482 Cr.P.C. may be permitted to be withdrawn and in respect of applicant nos. 2 to 6 who are the family members, the present criminal proceedings may be quashed. 4. Learned A.G.A. and learned counsel for opposite party no. 2 also have no objection as the allegation against family members are omnibus, vague and general in nature. 5. In view of the consent given by learned counsel for applicants and opposite party no. 2 as well as learned A.G.A., application under Section 482 Cr.P.C. in respect of applicant no.1- Rohdas is dismissed as withdrawn. 6. In respect of applicant nos. 2 to 6, namely, Jay Prakash, Smt. Rambeti, Neelam Devi, Jogendra Nath and Smt. Kamlesh are concerned, in view of consent/agreement reached between learned counsel for applicants and learned counsel for opposite party no. 2, the criminal proceedings against applicant nos. 2 to 6 in the above mentioned case are hereby quashed. However, the trial in respect of applicant no. 1-Rohdas may be proceeded in accordance with law. 7. With the aforesaid observation/direction, the present application is disposed of.
