The present petition has been filed by the petitioner seeking following prayers:- 10.1” This Hon;ble Court may kindly be pleased to issue an appropriate writ, thereby setting aside/quashing the impugned list (Annexure P/1) so far it relates to declaring the petitioner as surplus Lecturer in his school and further be pleased to direct the respondents to allow the petitioner to continue at his present place of posting. 10.2 That, any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the costs of the petition may be given. 3. Learned counsel for the petitioner submits that without giving an opportunity of hearing, the respondent authority has passed the impugned order (Annexure P/1) declaring the petitioner as Surplus Teacher in the School. 4. On the other hand Mr. R.S. Marhas, learned Additional Advocate General, appearing for the respondents opposes the submission advanced by the learned counsel for the petitioner and submits that no order has been passed by the competent authority against the petitioner and Annexure P/1 is the list by which he has been declared as one of the Surplus Teacher and the petitioner has a right to make a representation for his grievance. 5. Be that as it may, the petitioner is at liberty to make a representation 3 before the competent authority for redressal of his grievance. If such a representation is made, the competent authority would do well to consider and dispose off the same in accordance with law by passing a reasoned and speaking order after affording an opportunity of hearing to the parties. It is made clear that this Court has not expressed any opinion on merits of the case. 6. With the aforesaid observation/direction, the writ petition finally stands disposed off.
