For Respondent : Mr. Hariom Rai, Panel Lawyer Hon’ble Mr. Ramesh Sinha, Chief Justice Hon’ble Mr. Bibhu Datta Guru, Judge Order on Board Per Ramesh Sinha, Chief Justice 07/08/2025 1 Challenge in this appeal is to the judgment of conviction and order of sentence dated 26.04.2023 passed in Special Criminal Case No. 39/2019 by the learned Additional Sessions Judge, FTSC (POCSO) Manendragarh, District Koria, whereby the appellant has been convicted for the offences under Sections 341 of the Indian Penal Code and sentenced to 1 month S.I. with fine of Rs. 100/- and under Section 376(2) (n) of the IPC to life imprisonment which shall mean remainder of natural 2 life with fine of Rs. 500/-. In default of payment of fine, the appellant has been sentenced to undergo 7 days S.I. and 1 year R.I. respectively. 2 At the outset, Mr. Alok Kumar Dewangan, learned counsel for the appellant submits that he has been appointed to argue the matter on behalf of the appellant through the High Court Legal Aid Committee, however, the appellant herein has engaged another counsel of his own choice who has filed Cr.A. No. 1342/2024 challenging the same judgment and wherein paper book has already been prepared, and as such, he may be permitted to withdraw this appeal. 3 Learned counsel appearing for other side has no objection. 4 Accordingly, this appeal stands dismissed as withdrawn.
