Heard Sri P.Nagendra Reddy, learned counsel for the petitioner and 2. Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State. 3. Learned counsel for the petitioner would submit that bailable warrant has been issued against the accused for his absence on the given date. The accused appeared before the Court and filed a petition under Section 70(2) of Cr.P.C., to recall the warrant. While recalling the said warrant, learned Magistrate imposed a condition for payment of 10% of the cheque amount to the complainant within 15 days from the date of that order. Learned counsel for the petitioner would submit that it is a bailable warrant. The court cannot impose such condition. 4 % 4. Learned Assistant Public Prosecutor fairly conceded that it is a bailable warrant and on appearance of the party before the concerned is deemed to be recalled. The question of i arise.
