For Respondent(s) : Mr. N.S. Dhakar, PP with Mr. Tapesh Agarwal, PP and Mr. Ashok Sharma, Adv., for complainant. HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 18/08/2025 1. These bail applications have been filed under Section 483 of BNSS on behalf of the petitioners, who have been arrested in connection with FIR No.203/2025 registered at Police Station [2025:RJ-JP:32302] (2 of 3) [CRLMB-9331/2025] Kotwali Bundi, District Bundi for the offences punishable under Sections 126(2), 115(2), 109(1) and 3(5) of BNS, 2023. After completion of investigation, police filed charge-sheet in this matter for the offences punishable under Sections 126(2), 115(2), 109(1), 3(5), 117(2) & 118(1) of BNS, 2023 and Section 4/25 of Arms Act. 2. It is contended by learned counsel for the petitioners that the accused-petitioners have falsely been implicated in this case. Learned counsel submit that none of the injuries sustained by the inured persons have been opined as dangerous to life. Two injures have been opined as grievous in nature and both are caused by blunt object. They argue that charge-sheet has already been filed, there are no criminal antecedents against the petitioners and trial of the case will take considerable time in its conclusion. They contend that the petitioners are in custody since 26.05.2025 and further custody of the petitioners would not serve any fruitful purpose. 3. Learned Public Prosecutor assisted by learned counsel for the complainant vehemently opposes the submissions made by the learned counsel for the petitioners. Learned Public Prosecutor submits that there is serious allegation against the petitioners as many as nine injuries have been found on the person of Deepak and three injuries have been found on the person of Amit. 4. I have considered the contentions. 5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the parties, especially considering the material [2025:RJ-JP:32302] (3 of 3) [CRLMB-9331/2025] available on record in the form of charge-sheet; none of injuries sustained by the injured persons have been opined as dangerous to life; absence of criminal antecedents and trial will take time in its conclusion as well as looking to the period of custody, but without commenting anything on the merits/demerits of the case, I deem it proper to allow these bail applications. 6. These bail applications are accordingly allowed and it is directed that accused-petitioners – 1. Vikas Bhatt S/o Omprakash, 2. Govinda Suman S/o Ramphool and 3. Shubham S/o Pappu shall be released on bail provided, each of them furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each to the satisfaction of the learned trial Court with the stipulation that they shall appear before that Court and any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so. 7. The observation made herein above is only for decision of these instant bail applications and would not have any impact on the trial of the case in any manner. (ANIL KUMAR UPMAN),J MADAN/S-189-190
