Captioned MC has been filed with a condonation of delay (CoD) prayer qua 58 days delay in filing a State appeal under Section 21 of ‘the National Investigation Agency Act, 2008 (34 of 2008)’ (hereinafter, ‘NIA’ for the sake of brevity). [2]
Mr. Niranjan Sanasam, learned State counsel, who is present before this Court on the VC platform, adverting to paragraph 3 of the petition, which contains a tabulation, submits that time was consumed in receiving proposals from the Law Department, view from the Home Department, records from the office of Public Prosecutor. [3]
Be that as it may, earlier, notice was issued to respondent, this Court is informed by the Registry that lone respondent has been duly served but has not chosen to come before this court either in person or engage a counsel. This Court having perused the support petition, being satisfied with the tabulation in paragraph 3, i.e, the reasons for delay and also taking note of the fact that lone respondent has not chosen to come to this Court and oppose the CoD prayer, deems it appropriate to write that captioned MC is ordered as prayed for, i.e., delay condoned and there shall be no order as to costs.
