05.03.2025 Heard Shri Akash Deep Sharma, learned counsel for the petitioner. Also heard Shri SS Baghel, learned Government Advocate and Shri P Acharya, learned counsel for the Objector.
1. The petitioner in CRMP-905 of 2021 has filed the petition for the following reliefs:-
“1) This Hon’ble Court may kindly be pleased to call for the entire records pertaining to the criminal case no.182/2021 pending before Ld Judicial Magistrate First Class, Dallirajhara, District-Balod (CG) 2) This Hon’ble Court may kindly be pleased to quash/set aside the impugned FIR & Charge sheet filed in connection with Crime no.64/2021 lodged at PS Rajhara, District-Balod (CG) and the subsequent criminal case registered as Criminal Case No.182/2021 pending before Judicial Magistrate First Class, Dallirajhara, District Balod (CG), in the interest of justice. 3) This Hon’ble Court may further be pleased to give such other relief(s) as this Hon’ble Court may deem fit, in the interest of justice.”
2. The petitioner in CRMP-479 of 2021 has filed the petition with the following prayer:-
“It is therefore prayed that, this Hon’ble Court may kindly be pleased to quash the first information report bearing Crime No.425/2020 registered at Police Station, Rajhara, District-
Crmp 905 and 479 of 2021 3 Balod (CG) for the offence punishable under Section 452, 354, 506 of Indian Penal Code, final report (Annexure P/1) and entire criminal proceedings initiated against the present petitioner in Criminal Case No.289/2020 pending before the learned Judicial Magistrate First Class, Dallirajhara, District- Balod (CG), in the interest of justice.”

Learned counsel for the petitioner would submit that he could not contact the petitioner as he is not responding.

Learned counsel for the objector would submit that in the present case, charges have been framed and the trial is in progress. The evidence of complainant in the case has already been recorded, whereas, the evidence of other prosecution witnesses are yet to be recorded. He would further submit that present case is pending before the Chief Judicial Magistrate, Balod.
5. In view of above submissions made by learned counsel for the parties, we are not inclined to quash the FIR as well as the charge-sheet, in such an advance stage of trial. Accordingly, both the petitions stand
