Heard Mr. T. Sk, learned counsel for the petitioner and Mr. R.R. Kaushik, learned Additional Public Prosecutor, Assam for the respondent no. 1 State. Mr. Sk, learned counsel for the petitioner has submitted that in view of the remedy of appeal under the proviso to Section 413 of the Bharatiya Nagarik Suraksha Sanhita, 2023 is available to the petitioner, the petitioner wants to withdraw the present criminal revision petition in order to avail the appellate remedy before the jurisdictional appellate forum. He has, thus, sought leave to withdraw the present criminal revision petition with liberty to avail such remedy. Mr. Kaushik, learned Additional Public Prosecutor has endorsed the said submission. In view of the above submission made by Mr. Sk, learned counsel for the petitioner, this criminal revision petition is allowed to be withdrawn, with liberty to the petitioner to avail the appellate remedy before the jurisdictional appellate forum under the proviso to Section 413 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
