2/23.09.2025 Heard learned counsel appearing on behalf of Petitioners and
learned counsel appearing on behalf of the State.
2. The petitioners are apprehending their arrest for the alleged offences registered under Sections 115(2), 118(1), 117(2), 109, 191(2), 191(3), 351(2), 352 of B.N.S. 2023, pending in the Court of learned Judicial Magistrate, 1st Class, Giridih, in connection with Jamua P.S. Case No.76 of 2025.

Learned counsel appearing for the petitioners submits that the false allegations are made against the petitioners of assault and there are general and omnibus allegations against all the accused persons and scuffle took place due to land dispute. He further submits that there are case and counter case between the parties.

Learned counsel for the State opposed the prayer and submits that the allegations are there of assault and even the injury has been received by the informant also.

5. Looking into the contents of the FIR, it appears that there are direct allegations of assault against petitioner No.2 and 3 and hence I am not inclined to grant anticipatory bail to petitioner No.2 and 3.
6. As such, anticipatory bail of petitioner No.2 and 3 are hereby rejected.
7. So far as Petitioners No.1,4,5 and 6 are concerned, there are general and omnibus allegations against the petitioners No.1,4,5 and 6, I am inclined to grant them anticipatory bail.
8. Accordingly, the petitioners No.1,4, 5 and 6 above named are
directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of their surrender / arrest, they shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) each with two sureties of the like amount of each to the satisfaction of learned Judicial Magistrate, 1st Class, Giridih, in connection with Jamua P.S. Case No.76 of 2025, subject to the condition as laid down under Section 482(2) of Bhartiya Nagarik Suraksha Sanhita, 2023.
9. This Anticipatory Bail Application is accordingly allowed and
disposed of.
