Jyotsna Rewal Dua, Judge This writ petition has been filed for the grant of following substantive reliefs:-
“i) That issue a Writ in the nature of Certiorari and thereby quash and set-aside order dated 11-06-2024 & 09-07- 2024 (Annexure-P/8 & P/10) whereby the representation of the petitioner has been rejected in a slip shod manner and by passing a most unreasoned order. ii) That a Writ in the nature of Mandamus may kindly be issued, directing the Respondents to restore one increment after one year i.e. after 1995 stopped for a period of one year vide office order dated 21-4-1995 and thereafter re-fixation of pay and pension of the petitioner be made and grant all consequential benefits in the interest of justice and fair play. iii) That the respondents may be directed to grant all consequential benefits from 23-04-1996 such as fixation, revision of pension and arrears etc.” 1 Whether reporters of Local Papers may be allowed to see the judgment? Yes
2. Petitioner in essence seeks release of his one increment. His representation to this effect has been turned down by the concerned authority. The case file shows that it was pursuant to penalty imposed upon the petitioner in disciplinary proceedings that his increment with cumulative effect was ordered to be stopped. The penalty order had been accepted by the petitioner.
3. Confronted with above, learned counsel for the petitioner sought permission to withdraw this writ petition. Prayer is accepted. The petition is accordingly dismissed as withdrawn. Pending miscellaneous application(s), if any, also stand disposed of. Jyotsna Rewal Dua 7th January, 2025 Judge (Pardeep)
