1. The petitioner has filed the instant petition claiming following reliefs:- 10.1 That this Hon’ble Court may kindly be pleased to call for entire records pertaining to the case of petitioner for kind perusal of this Hon’ble Court. 10.2 That this Hon’ble Court may kindly be pleased to direct the respondents to refrain from any coercive action against the petitioner on application dated 19/05/2025 (Annexure P-9), in the interest of justice. 10.3 Any other relief, which may be deemed, fit by this Hon’ble Court just and proper in the facts and circumstances of the case may also be provided in favour of the petitioner. 2. The brief facts of this case are that Respondent No.6 filed a writ petition bearing WPC No.2537 of 2024 and the said writ petition was disposed of with a direction to the respondents No.3 to 5 therein to consider and decide the pending representation of the petitioner therein and to pass appropriate order after affording due opportunity of hearing to the interested parties.
Thereafter, one contempt petition bearing Contempt Case No.663/2025 was filed by the Respondent No.6 and the said contempt petition has been disposed of on 06/05/2025 with a direction to the respondent to consider the pending representation of the petitioner and to pass necessary orders. Thereafter, a notice was issued to the petitioner on 09/05/2025 to remove the illegal construction and the petitioner has also removed the illegal construction vide Annexure P/8. However, Respondent No.6 being not satisfied with the same has written a letter to
3 / 3 Respondent No.4 to take action against the petitioner. 3. Now the petitioner apprehends that under the undue influence of Respondent No.6 other respondents may take coercive steps for demolishing the constructed area of the petitioner’s residence situated at Bayron Bazar, Raipur. Hence the instant petition has been filed. 4. Be that as it may, no show-cause notice has been issued to the petitioner and only on the basis of the apprehension the present petition has been filed, therefore, no orders can be passed. However, it is directed that Respondents No.1 to 5 if they want to demolish the constructed area of the petitioner, they will follow the statutory provisions and guidelines and shall proceed in accordance with law. 5. With the aforesaid observation, the writ petition stands disposed of. SD/- (Arvind Kumar Verma)
