NAGA RAJU KOLLATI Advocate for the petitioner and of PUBLIC PROSECUTOR, for the Respondent; The Court made the following ORDER: Dr_YLR,J Crl.P.No.7414 2025 Dt.ll.08.2Cl25 The Court made the following ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity fthe BNSSJ) by the petit'loner/Accused No.5 for granting of Pre-arrest ba'll in connection with crime No.37 of 2025 of Prohibition and Excise Police Station, Repalle, reg-lstered for the alleged Offence Punishable under Section 34(a) of A.P. Excise Amendment Act, 2023. 2. The case of`the PrOSeCut'lOn iS that On 03.07.2025, on reliable i information, the prohibition & Excise officials, Mangalagiri along staff t\ and mediators proceeded to the scene of offence and found two persons. on inspection of the scene of offence, the police found 21 empty plastic cans of 35 liters capacity each. The police further found 510 empty plastic bottles Of 180 ml each without lids and labels. On interrogation, the apprehended persons revealed that the petitioner/Accused No.5 herein is supplying the bottles and labels used for 180 ml PET bottles of liquor,. Basing on the statement made by Other accused, the petitioner herein -ls arrayed as Accused No.5 in this case. 3. Per confra, Ms.P.Akhila NajduJ the learned Ass]-slant publl|c prosecutor vehemently opposed the grant of pre-arrest ba" to the petitioner, submi{{I.ng that the ,|nvestiga{ion is sti" underway and several materI'al witnesses remain {o be examined. l{ is contended that if the petI'tiOner is released on pre-arrest bau there is a strong likelihood that he may abscond, t'`hereby hampering the ongoing investigatl-on and evading the process of law. [n view of the foregoing, jt is urged that the Petition be dismissed. 5. Heard the learned counsel for the pe{itjoner and the learned Assistant public Prosecutor. perused the record. 6. On perusal of the record, the aIIega{l'on leveled agal-ns{ the peti{joner/Accused No.5 l's that the main accused has purchased bottles and labels used for 180 ml PET bottles of liquior. ' The petitioner/Accused No.5 shall make h'lmSelf available for investigation as and when required; iii. The petitioner/Accused No.5 shall not Cause any threat, inducement or promise to the prosecution witnesses-, iv.
