Neutral Citation No. - 2025:AHC:128496 Court No. - 34 Case :- WRIT - C No. - 6732 of 2025 Petitioner :- Ram Sarik Respondent :- State Of U.P. And 7 Others Counsel for Petitioner :- Saurabh Kumar Pandey Counsel for Respondent :- C.S.C.,Rameshwar Prasad Shukla Hon'ble Rohit Ranjan Agarwal,J. 1. The petitioner is aggrieved by the order passed for removing the obstruction, which has been raised on Gata No.272 which is the Government land. Further, by the order impugned, it has been ordered that a first information report be lodged against the petitioner. 2. The petitioner claims that in respect of Plot No.273, which is his bhumidhari, he has already filed a suit for demarcation under Section 24 of the U.P. Revenue Code, 2006 (hereinafter called as "the Code"). 3. Once it is an admitted case that demarcation proceedings are pending consideration, no useful purpose would be served in keeping the writ petition pending and the writ petition is being disposed of directing the revenue authorities to conclude the proceedings under Section 24 of the Code within a period of two months from the date of production of a certified copy of this order before him. 4. However, it is made clear that any obstruction standing over plot No.272, which is recorded as government land, shall immediately be removed and it should be freed from encroachment. 5. However, lodging of first information report against the petitioner shall be stayed till the disposal of proceedings under Section 24 of the Code. 6. With the aforesaid direction, writ petition stands disposed of. Order Date :- 31.7.2025 Kushal Digitally signed by :- KUSHAL AGRAWAL High Court of Judicature at Allahabad
