ARRABOLU SAI NAVEEN couNSEL FOR THE RESPONDENT : PUBLIC PROSECUTOR THE COURT MADE THE FOLLOWING ORDER THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION No.106 OF 2025 ORDER: This Criminal PetI'tl-On, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A3, seeking bail, in Crime No.110/2024 of Cheedikada Poll'ce Station, Anakapa[Ie District. 2. A case has been registered against the petitioner and Others for the offences under sections 20(b)(ii)(C), 25 read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act. 3. The case of the prosecution is that: On 17.9.2024 at about 2.00 pm, on receipt Of Credible I-nfOrmatiOn regarding illegal possession and transportatI'On Of ganja, S,I of Police, Cheedikada Police Station, along with staff reached the Outskirts Of Appalarajupuram Village and conducted vehicle Checking. Then police intercepted a Honda City Silver colour car bearing registration No.TN olY 1208 and found two accused who are Al and A2, while transporting 50 kgs of ganja. Then police apprehended them and got remanded to judicial custody. Basing on their confessional statement, the petitioner herein was arrested on 28.9.2024 and remanded tO judicial Custody. 4. Heard. Perused the record. t_-rf \ 2 5, Learned Assistant Public Prosecutor submits that major part of the investl-gation is completed except filing of charge sheet. 6, A perusal of the material available on record goes to showthat the petitioner/A3 was arrested and remanded to judicial custody on 28'9-2024, Basing on the confessional statement of co-accused, the petitioner has been shown as an accused in the present crime. The accusation is against the co_accused only. Police, on credible information, allegedly seized 50 kgs of ganja from the CO-accused. Except the confessional statement, there is no other material to connect the petI'tiOner With the Crime. Pursuant to the confessional statement of CO-accused, nothing has been Seized from the Petitioner. 7. In view of the aforesaid facts and circumstances of the case, this Court is incII-ned tO grant bail to the petitioner herein, on the following conditions. (i) The petitioner/A3 herein shall be released on hI'S executing a personal bond for Rs.10,000/-(Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the learned I Additional District and Sessions Judge, Visakhapatnam; (ii) On release, the petitI'Oner Shall appear before the Station House Officer concerned once in a week i.e. on every Sunday between 10.00 a.m. and 05.00 p.m., till filing Of Charge Sheet. 8, Accordingly, the criminal petition is allowed. -iBJ //TRUE COPY// Asss:sScTDTi-olS;K#FD±AETF:AR For AOv._ _ Tot 1.
