1. Heard Mr. D. Chakrabarty, learned counsel for the petitioner. Also heard Mr. P. Borthakur, learned Additional Public Prosecutor for the State.
2. This petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner, namely, Mantu Das, has prayed for granting pre-arrest bail, apprehending arrest in connection with Dispur P.S. Case No. 747/2025, registered under Section 306 of BNS, 2023 (GR No. 4427/25).

The case arose out of an FIR lodged by one Mohini Rai representing the firm Badri Rai & Company with the allegations that an amount of 25 lakhs was taken out for labour payments and kept at a certain place but subsequently, 17.5 lakhs was found short and around the same time the petitioner was also found to be evasive.
4. It is submitted by the learned counsel for the petitioner that pursuant to grant of interim, he has appeared before the IO and the statement has also been recorded where he has denied the allegations.

Learned Additional Public Prosecutor fairly submits that though the investigation so far revealed limited adverse materials against the petitioner but the needle of suspicion continues to be directed at him. He further submitted that investigation has progressed but still continuing. The statements of some co-employees are of an implicating nature in as much as they have stated that the amount of Rs. 25 lakhs was kept in the house of the petitioner.
6. In view of the nature of the materials and the allegations, I am of the considered view that it may not be prudent to continue the interim anticipatory bail.
7. Accordingly, this bail application stands rejected and disposed of.
8. The interim order passed earlier stands vacated.
9. Return back the case diary.
