Dr. YLR, J` CrI.P.No.7385 of 2025 Dated 23.07.2025 The Court made the following: ORDER: The CrimI-nal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha SanhI'{a, 2023 (for brevity t{he BNSS]) by the petitioner/Accused No.3 for granting of pre-arrest bail in connection with Crime No.96 of 2025 of Koilakuntla Police Station, NandyaI District, registered for the alleged offences punishable under Sections 318 (4), 316 (2), 351 (2) and 61 (2) read with 3 (5) of the Bharatiya Nyaya Sanhi{a, 2023 (for brevity fthe BNSJ)
2. The case of the prosecution is that on o4.06.2025 at Kilakuntla Town, Accused Nos.1 to 8 cheated the complainan{ and others by operatI-ng a Private financial company under the name JANANI MACS LTD in the house of Guvvala Padmavathi, collecting amounts from the complainant and others. The complainant paid Rs.5,000/- every month as a recurring deposit (RD) from 09.05.2022 to 31.03.2025, amounting {o a total of Rs.2,18,000/-. However, the accused failed to repay the maturity amount and also threatened the complainant with dire consequences. The accused conspired and committed cheating and criminal breach of trust against the complainant and others. Basec] on +~is

Ms.Akella Padma, the learned counsel for the Petitioner, Submits that the petitioner has not committed any offence; he was falsely implicated in this case; he is the sole breadwinner of his family; he is ready to abide any conditions to be imposed by this Court; and urged to grant pre-arrest bail to the petitioner/Accused No.3. 4. Per contra, Ms. P.Akila Naidu, the learned Assistant Public prosecutor, opposed in granting of bail stating that investigation iS not yet completed; if the petitioner is granted pre-arrest bail, he will repeat the same offence, and urged to dismiss the bail petition. 5. Perused the record. 6. As seen from the record, the de-faCtO COmPlainant in her complaint implicated almost all the family members of the Accused No.1, who is the chief Executive Officer of Janani Mutually Aided Co-operative society (MACS). The petitioner is a practicing Advocate in Telangana High Court. Considering the nature of the allegations leveled agaI'nS{ the Petitioner/Accused No.3, his alleged role played in {hI-S Case, this Court deems it fit to grant pre-arrest baI'l tO the Petitioner/Accused No.3. 8. In the result, the criminal petition is allowed with the following conditions: i. In the event of his arrest, the petitioner/Accused No.3 shall be enlarged on bail subject to he executing a personal bond for a sum of Rs.10,000/-(Rupees Ten Thousand only), with two sureties for the like slim each {O the Satisfaction Of the arresting police offI|Cia[S; ii. The petitioner/Accused No.3 shall make himself available for investigation as and when required; iii. The petI-tI-Oner/Accused No.3 shall not cause any threat, inducement or promI-Se tO the prosecution witnesses; iv.
The petitioner/Accused No.3 shall appear before the Station House OffI'Cer COnCerned Once in a week I'.e., On every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet.
