Heard Mr. M. Haque, learned counsel for the petitioner. Also heard Mr. R.J. Baruah, learned Addl. P.P. appearing for the State respondent.
2. This application under Section 483 of BNSS, 2023 has been filed by the accused petitioner, namely, Md. Sirajul Hoque Choudhury @ Sirajul Hoque, praying for grant of bail in connection with Tezpur P.S. Case No.719/2025, U/S Section 105/281 of the BNS Act, 2023. He was arrested on 03.11.2025.
3. The gist of the allegation in the FIR dated 03.11.2025 is that one person was found on the road with severe injuries and was dead. It is alleged that the petitioner driving his said vehicle caused the death of the said person. The driver of the vehicle attempted to flee without informing the police after causing the accident and therefore, he was apprehended.
4. The case diary has been received.
5. It is submitted by prosecution that so far investigation has not found eyewitnesses and it prima facie appears to be a case of accident; that the materials so far are indicative of the incident being an accident and there is also reasonable progress in the investigation.
6. In the given circumstances, allowing this bail application, the accused person is hereby allowed to go on bail of Rs. 25,000/- with one surety of like amount to the satisfaction of the learned concerned Court and subject to the following conditions that:-
Page No.# 3/3 (i) That the accused person shall not abscond. (ii) That the accused person shall not hamper or tamper with evidence.
7. Violation of any bail conditions will entail cancellation of the bail.
8. This bail application stands allowed and disposed of.
