Sinha, learned counsel for the petitioners. Also heard Mr. B. Sharma, learned Addl. Public Prosecutor, Assam appearing for the State respondent. 2. This petition under Section 482 BNSS is filed for granting the privilege of pre-arrest bail to the petitioners, namely, (1) Ram Kumar Mandal (2) Ajay Kumar and (3) Anil Kumar, apprehending arrest in connection with Sonapur P.S. Case No. 95/2025 registered u/s 329(3)/117(2)/130/109/3(5)BNS read with other provisions under the special statute. 3. The FIR lodged on 8/6/2025 revealed that a group of 13 workers were brutally assaulted by fellow workers within the premises of GM Coke Industries and that the victims were beaten with iron rods and blunt objects on their head and various parts of the body. It was also alleged that two child workers were present in the said fight and that one of the victims had sustained grievous injuries. 4. Mr. Sinha, learned counsel for the petitioner, submits that none of the petitioners were named in the FIR and that during the investigation their names appeared. He further submits that the incident related to a group Page No.# 3/3 clash between two groups and there were injuries sustained by workers of each group. He further submits that the petitioners were enlarged on interim pre-arrest bail vide order dated 17/12/2025 with the condition that the petitioners would appear before the investigating officer within a period of 7 days from the date of the order. 5. In compliance of the same, the petitioners appeared before the investigating officer and got their statements recorded and the said stand is acceded to by the learned Additional Public Prosecutor Mr. Sharma on perusal of the case diary. Mr. B. Sharma, learned Additional Public Prosecutor further submits that the petitioners were interrogated on 24/12/2025 and their statements were recorded. 6. In view of the submissions made, this court finds it fit to make the order dated 17/12/2025 absolute under the following conditions: (i) The petitioners to appear before the investigating officer as and when called for; (ii) The petitioners to cooperate with the investigation; (iii) The petitioners should not influence the witness or tamper with the evidence of the case. 7. Accordingly, the bail application stands allowed and disposed of. 8. Return the case diary. JUDGE Comparing Assistant
