03/ 15.09.2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners are apprehending their arrest in connection with Rajnagar P.S. Case No. 49 of 2025, registered for the offences under Sections 303(2), 316(3), 316(5), 318(4), 316(2) and 3(5) of Bharatiya Nyaya Sanhita, pending in the court of learned Judicial Magistrate, 1st Class, Seraikella.

Learned senior counsel appearing for the petitioners submits that the petitioner No. 1 is the owner of vehicle bearing registration number JH-09-BE-9722 and petitioner No. 2 is also the owner of two vehicles bearing registration numbers JH-02-BP-8671 and JH-02-BP-7345. He submits that pursuant to the work order, Rungta Mines Ltd., Chaliyama Steel Plant had given work to Rajnandini Transport, Tata Kandra Main Road, Gamaria, of which owner is Ganesh Choudhary, for transporting the coal and the owner of

Rajnandini Transport namely Ganesh Choudhary was responsible for transporting the said alleged coal and as such the petitioners being only the owners of the Vehicles had no interference in the work order which was between the company and the Transporter, as the Vehicles of the petitioners were plying under the said Rajnandini Transporter on hire. He further submits that the allegations are made that inferior quality of coal was supplied to Rungta Mines Limited.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are there of supply of inferior quality of coal.

Considering that the agreement for supply of coal was between the Rungta Mines Ltd. and Rajnandani Transport and the petitioners are said to be the owners of the trucks, which have been hired by the said transporter, I am inclined to provide the privilege of anticipatory bail to the petitioners.

Accordingly, the petitioners, named above, are hereby
directed to surrender before the learned court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Seraikella, in connection with Rajnagar P.S. Case No. 49 of 2025, subject to the conditions as laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
