Heard the counsel for the applicant. The present contempt application has been filed pleading willful disobedience of the order dated 6.12.2024 passed by this Court in Writ - C No. 31146 of 2024 whereby this Court had passed the following directions : - "4. Upon perusal of the documents and after hearing the parties, we direct the respondent no.4 not to interfere in any manner in the construction of petrol pump of the petitioner. The Superintendent of Police of the district is also directed to look into the matter and ensure compliance of order passed by this Court." A perusal of the different records annexed with the affidavit disclose that there is some dispute regarding partition of a plot between the applicant and other co-owners. The dispute is civil in nature. The Superintendent of Police has no jurisdiction to interfere in a private dispute between the parties. Apart from the aforesaid, till the plot is partitioned in the revenue records, the order as passed by this Court cannot be complied by the Superintendent of Police. The order is impossible of compliance, therefore, the revenue officers and police officers cannot be tried in contempt on the pleas raised in the contempt application. The application is dismissed.
