Heard Mr. M. A. Sheikh, learned counsel for the petitioner. Also heard Mr. B. Sarma, learned Additional Public Prosecutor for the State.
2. This petition has been filed under Section 482 of the Bharatiya Nagarik
Page No.# 2/3 Suraksha Sanhita, 2023, whereby the petitioner, namely, Mufasina Begum @ Mubasina Begum, has prayed for granting pre-arrest bail, apprehending arrest in connection with Laharighat P.S. Case No. 117/2025, under Section 21(b) of NDPS Act.
3. The investigation is in progress in this case arising out of an FIR dated 01.06.2025, where, it is alleged that 10.5 grms. of suspected heroin was seized from the petitioner. She was found trying to sell contraband in that area and that the police operation was conducted as per information and also with the help with another accused.
4. Mr. Sheikh, learned counsel for the petitioner submits that with regard to the allegation that the petitioner fled away from one home when she was kept, the petitioner denies the same. It is also submitted that she has a minor child to look after and there, seeks bail.
5. Mr. B. Sarma, learned Addl. P.P. submits that the investigation has supported the allegation of recovery of heroin/contraband from the petitioner and that she is involved in selling of narcotic drugs and that, she is a habitual offender.
6. The case diary has placed before me. The statement of the witnesses lends support to the allegation of recovery of heroine.
7. Upon perusing the materials, I find force in the contention that the petitioner is prima facie involved in trafficking of narcotic drugs. In these circumstances, at this stage, this is not a fit case for grant of pre-arrest bail to the petitioner, which accordingly stands rejected, at this stage.
