RAVI KUMAR (SC FOR A.P.S.W.R.S) The Court made the following ORDER: The writ petition is filed seeking indulgence of this Court, praying the following relief:- “……declaring the action of the Respondents in not continuing the services of the Petitioner as Principal working at A.P.S.W.R.S. Junior College, Rudravaram, Krishna District, until the Petitioner attains the age of superannuation of age of 60 years, pursuant to the G.O.Ms. No. 147, dt. 30-06-2014 and G.O.Ms.No.67, dt. 12-10-2015, adopted by the 3rd Respondent by amending the byelaws by duly incorporating Rule 13 of the byelaws to effect enhancing the age of superannuation of the employee working in 3rd Respondent Society from 58 to 60 as illegal, arbitrary, irrational, unconstitutional and violative of Article 14 of Constitution of India and consequently direct the Respondents to continue the Petitioner in service in the post of 2 Principal at A.P.S.W.R.S. Junior College, Rudravaram, Krishna District, till the Petitioner attains the age of superannuation of 60 years in the interest of justice and pass……” 2. The sum and substance in the present lis is that the petitioner is seeking continuation of her service in the 3rd respondent-Society upto the superannuation age of 60 years. 3. Today when the matter is called, none appeared for the petitioner. 4. On the other hand, Sri P. Ravi Kumar, learned Standing Counsel for the 3rd respondent-Society, with reference to the proceedings vide Rc.No.H.R.I/23117A/2017 dated 05.10.2018 issued by the 3rd respondent, submits that the petitioner services were extended upto the age of 60 years and subsequently, she retired from service on 31.01.2019. Making the said submission, learned Standing Counsel states that the cause in the lis does not survive for adjudication and seeks closure of the writ petition. 5. In view of the above submissions, the writ petition is closed by making the proceedings dated 05.10.2018 as part of record. There shall be no order as to costs.
