3 % TCDS,J W.P.No.18237 of2025 The Court made the following order: The petitioner is the permanent dealer of Fair Price Shop No.1084085 of Mangatam Village, Tirupati Urban Mandal, Tirupati District. It is the case of the petitioner that she was appointed as the fair price shop dealer in the year 2013, and since then, she has been distributing essential commodities to cardholders without there being any complaint from anybody. The authorization of the petitioner is being extended from time to time, and she filed an application seeking to renew her authorization on 02.03.2025 before the 4 respondent by paying the requisite fee. The said application is pending
consideration. Be that as it may, the inspection was conducted on 04.07.2025 in the Fair Price Shop of the petitioner and found certain variations in stock. Thereafter, a panchanama was prepared on the same day recommending to take appropriate action against the petitioner including initiation of proceedings under the Essential Commodities Act. It is further case of the petitioner that a show-cause notice dated 05.07.2025 was issued by the 4 respondent, calling for explanation from the petitioner as to why her authorization shall not be cancelled. To which, the petitioner has submitted explanation on 09.07.2025, and the same is pending respondent. It is further case of the petitioner that despite submission of explanation, the 4'^ respondent th th th consrdeTation before the 4
4 TCDS,J W.P.No.18237 of 2025 is yet to pass orders. It is further stated that without initiating any th action either suspending or cancelling the authorization, the 4 respondent stopped supplying the essential commodities to the petitioner. Questioning the said action, the present writ petition is filed. 2. On the other hand, the learned Government Pleader for Civil Supplies would submit that, pursuant to the show-cause notice dated 05.07.2025, the explanation dated 09.07.2025 submitted by the petitioner was received on 14.07.2025, and appropriate orders would be passed after following the procedure contemplated under law. During the course of hearing, the learned Assistant Government Pleader for Civil Supplies has fairly submitted that, as on today, no orders have been passed against the petitioner except issuance of the aforementioned show-cause notice. Having considered the submissions made by learned counsel on either side, this Court feels that it is appropriate to dispose of the writ petition directing the 4*'^ respondent to supply essential commodities to the petitioner as long as the authorization of the petitioner is subsisting. 3. 5 TCDSJ W.P.No.18237 of 2025 % With the above direction, the Writ Petition is disposed of. 4.
