Neutral Citation No. - 2025:AHC:35778-DB Court No. - 29 Case :- WRIT - C No. - 7257 of 2025 Petitioner :- Krishna Kumar Respondent :- Union Of India And Another Counsel for Petitioner :- Ramesh Pundir,Rekha Pundir Counsel for Respondent :- A.S.G.I. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Instructions are taken on record, a copy of which has also been made available to learned counsel for the petitioner. Petitioner is aggrieved by an order dated 18.01.2025 passed by respondent no. 2, whereby the request for change in the name of petitioner's son has been rejected. The order impugned records that rejection on account of lack of adequate proof of identification furnished by the petitioner.
Learned counsel for the petitioner submits that all relevant documents have already been furnished but they have not been taken note of. Learned Standing Counsel points out that Schedule II Regulation 10 (2) and 19 (4) of the Aadhar (Enrollment and Update) Regulations, 2016, such documents in respect of proof of identification since have not been furnished by the petitioner, therefore, the claim of the petitioner has not been considered. It is submitted that still if the petitioner so wishes, he may file fresh application annexing such proof of identification documents and the authority would accord consideration to such request notwithstanding the rejection of the earlier claim. In view of the stand taken by the respondents, we dispose of the writ petition, with liberty to the petitioner to approach the
second respondent along with proof of identification documents as are specified in the Schedule-II of the statute, along with a copy of this order. If the petitioner does so, the second respondent shall accord consideration to petitioner's claim, within a period of four weeks, thereafter. Sri Vinay Kumar Singh, Advocate has appeared for Union of India.
