Heard learned counsel for the applicant Mr. K.K. Bhatta. Also heard Mr. M.H. Laskar, the learned counsel for respondent no. 1.
2. The present application has been filed u/s 5 of the Limitation Act praying for condonation of delay of 40 days in filing the connected MAC Appeal which has been filed against the impugned judgment & order dated 22.11.2023 passed by the learned Member, MACT, Karimganj in MAC Case No. 47/2018.
3. No unserved notice on respondent no. 2 has arrived till date.
4. Today when the matter was called none appears for respondent no. 2.
5. This present application has been filed by the applicant with the reason that file has been sent to the Head Office for approval and consequently some considerable time has been taken in movement of the file from one office to another taking the decision. The engaged counsel required atlest 4/5 days in preparing the Memo Appeal. Accordingly there is delay of 40 days in filing the connected appeal.
6. This Court is of the view that sufficient cause has been shown and therefore the delay of 40 days is condoned.
7. The application is allowed.
8. Registry is directed to register the connected MAC Appeal and list the same after the winter vacation.
