Neutral Citation No. - 2025:AHC:69241 Court No. - 6 Case :- WRIT - A No. - 2672 of 2025 Petitioner :- Chandan Kumar Bardhan Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Virendra Kumar Yadav Counsel for Respondent :- C.S.C. Hon'ble Saurabh Shyam Shamshery,J. Heard Sri Virendra Kumar Yadav, learned counsel for petitioner and Sri Akhilesh Kumar Sharma, learned counsel for B.S.A. The petitioner has tried to make out a case to grant gratuity since his wife has died in harness on 10.05.2016 and has approached this Court after a period of 8 years, however, an affidavit filed by concerned respondent discloses that son of present petitioner, deponent of present writ petition, has stolen the file from the office and has not returned it and considering that such allegation is vaguely denied in rejoinder affidavit, therefore, relief sought cannot be allowed. In aforesaid circumstances, petitioner as well as his son, are themselves guilty that gratuity amount is not paid till date, therefore, this writ petition is disposed of with an observation that if entire documents are submitted by petitioner himself in office of concerned respondent, only thereafter his claim will be considered. It is directed that deponent will not enter in the office of concerned respondent and as there is an allegation against him of theft of a file. In view of above, on prayer of counsel for respondent, if the cost imposed by an earlier order is still not paid, it is exempted. Order Date :- 1.5.2025 P.
