Zaid Ahmed, learned counsel for the petitioner and Mr. Subodh Kr. Dubey, learned A.P.P. for the State. The prayer for bail of the petitioner was earlier rejected thrice in B.A. No. 1960 of 2023, B.A. No. 11241 of 2023 and B.A. No. 10391 of 2024. Submission has been advanced by the learned counsel for the petitioner that the petitioner is in custody since 23.11.2022. It has further been submitted that two of the co- accused who had taken part in the abduction and commission of rape namely, Saddam Hussain and Md. Arif have been convicted but they have been granted bail in their respective appeals. Learned A.P.P. has opposed the prayer for bail of the petitioner. It appears that Saddam Hussain and Md. Arif have been granted bail in appeals they have preferred against the judgment of conviction on account of the fact that they have spent seven years in custody. So far as the present petitioner is concerned, he is in custody since 23.11.2022. There is a specific allegation against the petitioner and other accused persons of abducting the informant and committing rape upon her along with the other co-accused persons. Regard being had to the above, I am not inclined to grant bail to the petitioner. This application accordingly stands rejected once again. (Rongon Mukhopadhyay, J.) A. Sanga/-
